第二個參考是參院司法委員會要求FBI交出所有科米處理郵件門的文案和通訊記錄的公文。索取記錄的原因是調查科米是否涉嫌 「in the Clinton investigation violated the Hatch Act".
目前初步的證據證實科米「the following key FBI interviews had not yet occurred when Mr. Comey began drafting his exoneration statement」。由於在郵件門的調查過程中FBI違規辦案，「先下結論，再收集證據（Conclusion first, fact-gathering second）」，使得整個郵件門的結論出現重大疑問。
而且，科米將自己置於了perjury和obstruction of justice的危險之中。在聽證會上有議員特意問科米：你的結論是在調查前寫的還是調查後寫的（我當時的反應是這是個什麼問題）？

我提供的那兩個參考只是陳述兩個事實證據：（1）林奇指示科米對外弱化案件性質的稱謂，（2）林奇在辦案期間私會嫌疑人的老公。如果林奇只是在辦案期間私會嫌疑人的老公或只是指示科米把郵件門定為matter，事情雖然也嚴重但還有可周旋之處，但二件事都發生了且有關聯性，性質就不同了。再加上科米的放水，這些擱一起，恐怕除了Perjury和Obstruction of justice之外，Corruption和Conspiracy也跑不了。
